Clinic Terms and Conditions

Personal liability policy

By registering for an Swim Better HQ program you confirm and agree to these terms and conditions and undertakings apply to the activities to be provided to you by Swim Better HQ, ABN 27 602 106 016, trading as ‘Swim Better HQ’.

  1. You have been examined by a licensed medical (“Practitioner”) within the past six months and have been found by such Practitioner able to perform all vigorous exercise, in and out of the water, which you are to perform during an Swim Better HQ program.
  2. You will faithfully follow all instructions given to you by Swim Better HQ and its Instructors as to when, where and how to perform and not perform exercises/activities.
  3. You agree and acknowledge that participation in any Swim Better HQ activities could constitute a risk of serious injury to yourself, including permanent paralysis or death. You voluntarily and knowingly recognise, accept and assume this risk and warrant that you are physically fit and able to perform the Swim Better HQ activities without risking serious injury, including permanent paralysis or death. You acknowledge that neither Swim Better HQ nor its Directors, Instructors or Employees shall be, nor deemed to be responsible or liable (whether in contract or in tort or under any statute whatsoever), for any injury, illness or other mishap you sustain arising from or out of, or in any way directly or indirectly connected with, the Swim Better HQ activities.
  4. You understand and acknowledge that you are to receive instruction in Swim Better HQ and activities, including activities on the land, beach and in the water, and theory only. Neither Swim Better HQ, its Directors, Instructors and Employees are not liable for, nor expected to provide any advice, training or medical assistance other than in the form of the Swim Better HQ activities.
  5. You indemnify and will at all times keep indemnified Swim Better HQ, its Directors, Instructors and Employees from and against all actions, suits, cause of action, proceedings, claims, costs and expenses whatsoever which may be taken or made against Swim Better HQ, its Directors, Instructors and Employees in connection with or arising out of any such injury, illness or mishap to you.
  6. The program fee paid by you to Swim Better HQ is non-refundable. Swim Better HQ may in its sole discretion grant refunds to you without prejudicing any of its rights.

Photography policy

At Swim Better HQ we take photos an videos part of our clinic and coaching process so we take lots of photos and videos during our programs and at events. These photos and videos are usually posted on Swim Better HQ social media accounts such as;  FacebookTwitterInstagram, and Linkedin (we only use first names and won’t tag you), they also might be used on our website or in advertising for Swim Better HQ online or other marketing materials and they’re sent to participants as a keepsake.

You can be assured that we’ll only use photos that look awesome and make you look amazing!

We ask that everyone accepts the Photography Waiver as it’s almost impossible to get photos of people in action without someone being in the background and we don’t like to ask people to move out of shot or not be a part of a group shot (because it puts them on the spot in front of others).

During the sign up process for all Swim Better HQ programs you’ll be asked to read and accept our Photography Waiver before you can participate in our programs.

Photography waiver

By registering for an Swim Better HQ clinic you consent to the use or reproduction by Swim Better HQ or its agents of photographs taken of you for the sole purposes of advertising, media publicity, publication, web display, general display or any other Swim Better HQ purposes in whole or in part. You hereby waive any interest that you may have in the copyright to the photograph(s) now or at any future time and state that you do not expect to receive any payment or consideration in respect of them. You release Swim Better HQ, its employees and agents from any liability (including consequential loss) connected with the publication, reproduction, release or other use of these materials.

Cancellation, transfer & postponement policy

At Swim Better HQ we believe we have a fair cancellation, transfer and postponement policy that takes into account:

  1. The natural and unpredictable environment we operate in,
  2. The premium level of service and water safety standards we provide, and
  3. That Swim Better HQ is a small business with high demand with limited capacity.

Without this policy, it would not be economical for Swim Better HQ to provide our programs.

Participants should be aware of the contents of this policy before registering for any of Swim Better HQ programs.

Why we have developed this policy

Swim Better HQ is committed to providing the highest level of training and support to our clients.

Hundreds of hours of preparation go into every Swim Better HQ clinics, and we have a small window of opportunity each season to provide the clinics we do, in a way that is profitable enough to ensure the ongoing viability of Swim Better HQ.

  • We appreciate that you would love for your training to be conducted in perfect conditions on warm, blue sky day.
  • We know that life can get in the way sometimes; maybe you forgot you had something else on, or you have been booked on a last minute work trip, or have taken ill.

Unfortunately, these are all factors that are out of Swim Better HQ’s control, and if we had an open policy for accommodating every participant’s needs, we simply would not be in a position to provide our programs.

Awareness of our policy

Ensuring you are aware of our cancellation policy is both Swim Better HQ’s, and the clients responsibility.

Swim Better HQ ensures that you are made aware of the policy by:

  • Making it known to you in our terms and conditions
  • Asking you to agree to our terms and conditions before making a purchase
  • Reminding you via a message bar on the checkout page

Participants are required to:

  • Read the terms and conditions before committing to a purchase
  • Agree to the terms and conditions by ticking the appropriate box on checkout
  • Respect the terms and conditions.

Participant cancellations, transfers & postponements

Glossary

  • Cancellation: A complete refund of the program fee.
  • Transfer: A switch to another date and time for an identical program.
  • Postponement: A rescheduling of a lesson to another date and time.

Clinics

Includes: Freestyle clinics, Special events, Online coaching

Cancellations and transfers are accepted prior to the clinic, as stated below, provided the requests are submitted in writing to swimcoach@swimbetterhq.com:

More than 48 hours prior

  • Cancellations – Permitted
  • Transfers – Permitted

48 hours prior (i.e. 3 Thursday before a Saturday clinic)

  • Cancellations – Not permitted*
  • Transfers – Permitted

Less than 48 hours before (i.e. 2 Friday’s before a Saturday clinic)

  • Cancellations – Not permitted*
  • Transfers – Not permitted*

*In some circumstances, we may be able to offer you a place in a future clinic, however, these places will only be offered at the last minute, if the clinic has not been sold out, and will almost never include January clinics. We are not obliged to offer this service.

There will be NO refund for participants who cancel their clinic with less than 48 hours before the start of the clinic.

In the instance that the clinics do not reach a require fill rate of 70%, the clinic may be cancelled.
